Infringement Claims/Digital Millennium Copyright Act Notice


PMC-Sierra respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement or any other violation of your rights, please provide the following information in writing to PMC's Copyright Agent:

  • an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  • a description of the copyrighted work that you claim has been infringed or material which otherwise violates your rights (or, if you claim that multiple copyrighted works at a single online site are infringing, a representative list of such works at that site);
  • a description of where the material that you claim is infringing/violating is located on the site;
  • your address, telephone number, and e-mail address;
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are, or are authorized to act on behalf of, the copyright owner or the owner of an exclusive copyright right that is allegedly being infringed.

Please note that in order to be effective notice under the United States Digital Millennium Copyright Act, your notice must include all of the above information. Claimants who make misrepresentations concerning copyright infringement may be liable for damages incurred as a result of the removal or blocking of that material, court costs and attorney’s fees.

PMC-Sierra’s Procedures
When a valid DMCA notification is received, PMC responds by taking down the offending content. On taking down content under the DMCA, we will take reasonable steps to contact the owner of the removed content so that a counter-notification may be filed. On receiving a valid counter-notification, we generally restore the content in question, unless we receive notice from the notification provider that a legal action has been filed seeking a court order to restrain the alleged infringer from engaging in the infringing activity. PMC may provide copies of such notices to the participants in the dispute or to any other third parties, at our discretion and as required by law. PMC's privacy policy does not protect information provided in these notices.

Required Information for Counter Notices

If material that you have posted to a system or network controlled or operated by or for PMC has been removed or disabled, you may file a counter notice pursuant to 17 U.S.C. §512 (g). To be effective, the counter notice must be a written communication sent to the address listed below that includes the following:

  • A physical or electronic signature of the subscriber;
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located or, if your address is outside of the United States, for any judicial district in which PMC may be found, and that you will accept service of process from the person who provided notification under subsection 17 U.S.C. §512 (c)(1)(C) or an agent of such person.
